Amendments to local government legislation since 1 July 2010

As Councils were advised in the local government bulletin 11/10, dated Friday 30 July, an issue was identified regarding the transitional provision for rating after Council amalgamations in 2007.

The department has now addressed this issue.

On 6 August 2010 a transitional regulation - backdated to 1 July 2010 - will commence. This transitional regulation allows the provisions to continue providing for Local Governments to prepare their annual reports and financial statements for the 2009–2010 financial year under the repealed Local Government Act 1993.

A transitional regulation under the City of Brisbane Act 2010 provides for the Brisbane City Council to prepare their annual report and financial statements for the 2009–2010 financial year under the repealed City of Brisbane Act 1924.

Amendments have also been made to the Local Government (Finance, Plans and Reporting) Regulation 2010 to:

  • clarify the rating calculations to be used in working out the averaged value of land that had not previously had a value (this amendment has also been made to the City of Brisbane (Finance, Plans and Reporting) Regulation 2010)
  • provide that any member of a Local Government’s audit committee is eligible for appointment as the chairperson of that committee.

The Local Government (Finance, Plans and Reporting) Regulation 2010 will be further amended to continue the transitional provisions relating to rating after Council amalgamations in 2007 to the original date of 30 June 2012. This amendment will occur before the end of the year.
